Gearhouse Broadcast awarded damages from Gerling And Associates Inc. in TV production trailer case

Sydney, Australia – A Jury for the United States District Court for the Southern District of Ohio Eastern Division has awarded Australian-based television broadcast services specialist Gearhouse Broadcast Pty Ltd, substantial damages in a case brought against it by Gerling And Associates Inc., a manufacturer of television production vehicles based in Sunbury, Ohio. The case relates to Gerling And Associates Inc. agreeing to supply a rack-ready television production trailer to Gearhouse Broadcast for use in Australia by its outside broadcast facilities provider business.

Due to the initial two month delay in the arrival of the trailer in Australia, Gearhouse Broadcast was forced to hire in an alternative trailer to meet the business commitments for which the new trailer had been earmarked. When the trailer eventually arrived in the country, it was discovered that it was too wide to meet the Australian regulations and could not be approved by the Regional Transportation Authority and registered to go on the road. In addition, the air-conditioning unit supplied was less powerful than what had been originally agreed, and therefore could not cool the interior enough for use in Australia’s hot climate. These issues came despite assurances from Gerling And Associates Inc. that it was fully aware of the required road regulations in Australia and would build a trailer that would meet them.

After Gearhouse Broadcast approached a reputable specialist in Australia to bring the trailer up to the required local standards so it could be deployed, legal action for breach of trade secrets was initiated by Gerling And Associates Inc. In response to this Gearhouse Broadcast successfully countersued, winning on all the counts presented to the jury, who awarded substantial damages from Gerling And Associates Inc.

Gerling And Associates Inc. is expected to appeal the Court’s decision.

“Gerling And Associates Inc. promised us the trailer in an accelerated timeframe and conformant with Australian rules, and yet following significant delays, what was eventually delivered did not meet those local regulations, with which they claimed to be familiar” said Adrian Young, commercial director at Gravity Media Group, the owner of Gearhouse Broadcast. “We attempted to reach an amicable settlement rather than proceed to trial. Despite having lost in court, Gerling And Associates, Inc. seem intent on continuing with an expensive appeals process for both parties, rather than coming to an amicable resolution.”
